Schacter Portnoy, on behalf of its client Cavalry Portfolio, sued our client at an address where he had not resided in over 17 years. The plaintiff had submitted an affidavit of service from a process server accused of "sewer service" in the Sykes v. Mel Harris et al. case which is currently pending in federal court. In opposition, we provided a copy of our client's lease for the relevant period, and rebutted the affidavit of service with specificity.
$25,880 Default Judgment ($18,259 Plus Accrued Interest); Vacated and Case Settled for $1,000
Our client was sued by Schacter Portnoy in a county where she did not reside. She was never served with a summons and complaint, allowing plaintiff to obtain a default judgment. We provided the court overwhelming evidence that our client did not reside in the county in which she was sued. We also raised as a defense that neither the court, nor our client, had been notified that the debt had been transferred from the original owner (DaimlerChrysler) to a debt buyer (Cavalry Portfolios) or that there had been a change of counsel. Such notice is required by state law.
