Related to the issue in our last blog post, we caused the dismissal of a $14,000 case on the grounds that the plaintiff, Unifund, CCR, LLC, waited too long to properly serve our client.
Almost a year after the action was filed, Unifund, represented by Pressler & Pressler, sought an extension of time to serve our client. We cross-moved for dismissal challenging Unifund's basis for the extension. We argued that Unifund and Pressler failed to cite a persuasive basis under a "good cause" standard or an "interest of justice standard."
