Meet Asset Recovery Solutions, LLC of Des Plaines, Illinois. We have been coming across letters by this entity demanding money on behalf of debt buyers. The problem? The letters seek money based on New York default judgments but the letters make no mention of the court cases or the judgments. The letters almost go out of their way to omit the case information that would apprise the consumer of that material fact. And in at least one of our cases, their response to our validation demand was a Bill of Sale that further confused the parties and the basic facts.
Our position is that the letters, and the responses to our demands, both violated several provisions of the FDCPA designed to avoid such deception. Based on these letters, a consumer would not be aware of a judgment, and the need to ensure that a satisfaction is duly filed in court following any payment.
